These Terms of Service ("Terms") govern your use of the website nikatru.com and the applications and games published by Nikatru ("Nikatru", "we", "us", "our") — a proprietorship of Rajasekar Selvam, Chennai, Tamil Nadu, India — across iOS, Android, Windows, macOS, Linux and the web (the "Services"). By downloading, accessing or using the Services, you agree to these Terms.
1. Eligibility
You must be able to form a binding contract in your jurisdiction to use the Services. If you use the Services on behalf of an organisation, you represent that you are authorised to do so.
2. Licence to use
Subject to these Terms, Nikatru grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use our apps for your own lawful use. You may not copy, modify, distribute, sell, rent, sublicense, reverse-engineer or attempt to extract the source code of our apps, except to the extent this restriction is prohibited by law.
3. Acceptable use
You agree not to misuse the Services, including by: breaking any law; infringing others' rights; attempting to disrupt, hack or overload the Services; or using them to distribute malware or harmful content. We may suspend or terminate access for violations.
4. Purchases, subscriptions and payments
- Some apps or features may be paid, offered as one-time purchases or subscriptions. Prices and what you get are shown at the point of purchase.
- Where an app store requires its own billing system for purchases made inside an app — the Apple App Store and Google Play — that store takes the payment and is the seller for that purchase, and the store's terms apply to it in addition to these Terms.
- For every other purchase — this website, the Microsoft Store, and our direct downloads for Windows, macOS and Linux — the seller is Paddle, acting as our merchant of record. That means Paddle, and not Nikatru, is the legal seller of that purchase: Paddle takes the payment, issues the receipt, and collects and remits any sales tax, VAT or GST due where you live, in every country we sell to, including India. Paddle's own buyer terms apply to that purchase alongside these Terms, and the Paddle entity named on your receipt is the party you contracted with. We do not sell anything directly from this website today; this is the arrangement that will apply when we do.
- Subscriptions renew automatically unless cancelled before the renewal date; you can manage or cancel through your app store account or as described in our Refund & Cancellation Policy.
- Prices are inclusive of applicable taxes unless stated otherwise.
5. Intellectual property
The Services, including all software, designs, text, graphics, logos and the "Nikatru" name and mark, are owned by Nikatru or its licensors and are protected by copyright, trademark and other laws. No rights are granted except the limited licence in Section 2.
6. Third-party services
The Services may link to or rely on third-party platforms and tools (app stores, payment processors, analytics). We are not responsible for third-party services, and your use of them is governed by their own terms.
7. Disclaimer of warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free.
8. Limitation of liability
To the maximum extent permitted by law, Nikatru will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, revenue or profits, arising from your use of the Services. Where liability cannot be excluded, it is limited to the amount you paid us for the relevant app in the twelve months before the claim.
9. Termination
You may stop using the Services at any time. We may suspend or end your access if you breach these Terms or where necessary to protect the Services or comply with law.
10. Governing law
These Terms are governed by the laws of India. The courts at Chennai, Tamil Nadu, India shall have jurisdiction, subject to any mandatory consumer-protection rights you have where you live.
11. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted here with a new date; continued use means you accept the changes.
